Family law: divorce, children and shared assets

Here is a brief overview of the main legal issues that arise when a marriage ends, and how we can guide you through the process.

A divorce can be obtained by mutual consent - amicably, before a notary or the court - or through litigation, when the parties cannot reach an agreement. Where there are children, the court decides on child custody, parental authority and the child’s residence.

The court also rules on child support and the visitation schedule, while assets acquired during the marriage are divided through the division of marital property. In cases of domestic violence, an urgent protection order can be requested to keep you and your children safe.

As a family lawyer in Timișoara, our firm assists you with discretion and patience at every stage - from the initial consultation and mediation between the parties, to representation in court. You can contact us whenever you need a divorce and family lawyer in Timișoara, Romania.

How long does a divorce take?

A divorce by mutual consent, with no children, can be finalised quickly before a notary. In court, or when there are disputes over children or assets, it takes longer and depends on the complexity of the case. We give you a realistic estimate after reviewing your situation.

As a rule, parental authority is exercised by both parents, while the child’s residence is established with one of them. The decision is always made in the child’s best interest, taking into account age, attachment and living conditions.

Child support is set in relation to the income of the parent required to pay and the needs of the child, within the limits set by law. It can later be increased or reduced if the circumstances change significantly.

The fee depends on the type of divorce - by mutual consent, before a notary, or contested in court - and on whether there are claims regarding the children or assets. We explain how the fee is calculated from the outset, so you know what to expect.

A protection order is an emergency measure through which the court can, among other things, remove the aggressor from the home and prohibit them from approaching the victim. We help you quickly obtain the protection you and your children need.
